a. that based on the result of an investigation conducted by the Indonesian Committee on Trade Safeguard in 2005-2007 period, which show a surge in the import of investigated goods, thereby inflicting serious losses on the domestic industry, the Ministry of Trade through letter No. 1597/M-DAG/5/2008 dated November 10, 2008, proposed to extended the imposition of safeguard measures import duty on the import of tableware ceramic products;
b. that based on consideration as intended in paragraph a and in effort to implement provisions in Article 23 D paragraph (2) of Law No. 10/1995 concerning Customs that is amended by Law No. 17/2006, it is necessary to stipulate the Imposition of Safeguard Measures Import Duty on the Import of Tableware Ceramic Products;

2. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) that is amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
3. Presidential Decree No. 84/2002 concerning Efforts to Safeguard the Domestic Industry form the Impact of Import Surge (Statute Book No. 133/2002);
4. Presidential Decree No. 20/P/2005;
REGULATION OF THE MINISTER OF FINANCE CONCERNING THE IMPOSITION OF SAFEGUARD MEASURES IMPORT DUTY ON THE IMPORT OF TABLEWARE CERAMIC PRODUCTS
The import of Tableware Ceramics kinds under headings 6911.10.00.00, 6911.90.00.00 and 6912.00.00.00 except toiletries products shall be subject to Safeguard Measures Import Duty.
The Safeguard Measures Import Duty as intended in Article 1 shall be imposed on the import of tableware ceramic products from all countries except produced in and imported from countries as intended in Attachment to this Regulation of the Minister of Finance.
The import of Tableware Ceramic products from countries excepted from the imposition of Safeguard Measures Import Duty as intended in Article 2, importer shall submit Certificate of Origin document.
The Safeguard Measures Import Duty as intended in Article 1 shall be imposed for 3 (three) years under the following condition:

| 3 | 3th Year January 4, 2011 until January 3, 2012 | Rp 1,100 (one thousand one hundred rupiah) per kilogram |
By the effective time of this Regulation of the Minister of Finance, Regulation of the Minister of Finance No. 01/PMK.010/2006 concerning the Imposition of Safeguard Measures Import Duty on the Import of Tableware Ceramic Products as amended by Regulation of the Minister of Finance No. 173/PMK.010/2008, shall be revoked and declared null.
1. This Regulation of the Minister of Finance shall come into force on January 4, 2009.
2. This Regulation of the Minister of Finance shall be valid for 3 (three) years since this Regulation of the Minister of Finance is put into force as intended in point 1.
For public cognizance, this Regulation of the Minister of Finance shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
